General Terms and Conditions of Sale (GTCS)
Preamble These General Terms and Conditions of Sale (hereinafter "GTCS") govern the contractual relationship between GOLD GROUP SAS (hereinafter "the Service Provider") and any natural or legal person wishing to make a purchase via the GOLD GROUP SAS website (hereinafter "the Client"). Any order placed on this site constitutes the Client's unreserved acceptance of these terms and conditions.
Description of Services GOLD GROUP SAS offers coaching and personal and professional support services. Sessions are primarily one-on-one but may include group sessions, particularly under the "90-Day Transformations" program. Details and specificities of the services offered are described on the GOLD GROUP SAS website.
Payment Terms Payment for sessions and programs is made in one installment via the website using a credit or debit card, through the payment provider STRIPE. A multiple-payment option (in 1, 2, or 3 installments) is under development and will be available in the future. All payments are secure, and the Client's banking data is not stored by the Service Provider.
In accordance with Article L. 313-1 of the French Monetary and Financial Code, any card transaction will be subject to validation and security procedures. The Service Provider reserves the right to refuse any order in the event of a payment issue.
Commitments and Obligations of the Parties
Obligations of the Service Provider:

Provide one-hour coaching sessions.

Deliver a session summary report to the Client.

Deploy all necessary means to ensure a high-quality service and to support the Client in achieving their goals.
Obligations of the Client:

Respect scheduled session times.

Provide all necessary information for the coaching process.

Cancel sessions at least 48 hours in advance; otherwise, the session will be considered delivered and billed.

Ensure that payment is made prior to each session.
In the event of non-compliance with these obligations, the Service Provider reserves the right to suspend or cancel services without notice or refund.
Withdrawal, Cancellation, and Refund Policy
Right of Withdrawal In accordance with Article L221-18 of the French Consumer Code, the Client has a 14-day withdrawal period from the order date, during which they may cancel the service without providing any justification or incurring penalties. To exercise this right, the Client must notify their decision in writing via email to: info.goldenwisdom@gmail.com.
However, pursuant to Article L221-28 of the same code, the right of withdrawal cannot be exercised for services fully executed before the withdrawal period ends and for which performance began with the Client’s express prior agreement and waiver of the withdrawal right. If the first session has already taken place, no refund will be granted.
For the "90-Day Transformations" program, given the limited slots and complex organization involved, no withdrawal or refund will be allowed once the order is confirmed and the program has commenced.
Session Cancellation

By the Client: Any cancellation must be made at least 48 hours in advance. Beyond this period, the session will be considered completed and non-refundable.

By the Service Provider: The session will be rescheduled with the Client’s consent. If the rescheduled session exceeds the validity period of the program, this period will be extended accordingly.
Refunds No refunds will be issued except where legally required. Sessions and programs not used within the validity period will be forfeited. In cases of force majeure or medical incapacity substantiated by a valid medical certificate, the Service Provider may, at their discretion, offer a partial or full refund.
Liability and Insurance
Liability The Service Provider undertakes to provide coaching services with professionalism and integrity, ensuring the physical and moral integrity of the Client and working with goodwill and benevolence. However, the implementation of coaching advice and recommendations remains the sole responsibility of the Client.
The Service Provider and its coaches cannot be held responsible for outcomes—whether achieved or not—as they depend entirely on the Client’s commitment, effort, and application of the coaching guidance. The Client acknowledges full responsibility for the use and implementation of any strategies and solutions proposed during coaching sessions.
In the event of improper application of coaching advice by the Client, the Service Provider shall not be liable for any resulting consequences. Recommendations are made professionally and in collaboration with the Client, with the aim of supporting their personal and professional development.
The Service Provider shall not be liable for service delays or interruptions caused by events beyond their control, as defined under Article 1218 of the French Civil Code (force majeure), including but not limited to telecommunications or internet network failures.
In any case, the Service Provider’s liability shall be limited to direct, proven damages suffered by the Client and shall not exceed the total amount actually paid by the Client for the services rendered.
Insurance GOLD GROUP SAS holds professional liability insurance compliant with Articles L. 241-1 and following of the French Insurance Code, covering damages that may occur in the course of service delivery. This insurance protects the Client against any direct harm resulting from the coaching services.
The Client is encouraged to take out personal insurance covering any risks associated with implementing the coaching advice.
These provisions shall survive any termination or cancellation of these GTCS.
Intellectual Property All programs, session content, and any materials provided remain the intellectual property of GOLD GROUP SAS. In accordance with Articles L. 111-1 and following of the French Intellectual Property Code, any unauthorized use, reproduction, or intellectual theft shall be subject to legal proceedings. The Client agrees not to reproduce, distribute, or use this content for any purpose other than personal use.
Personal Data Clients’ personal data is managed in compliance with the General Data Protection Regulation (GDPR) (EU Regulation 2016/679) and French Law No. 78-17 of January 6, 1978, as amended by the Law of June 20, 2018. Data is stored securely in private, non-shared files. The Service Provider commits to not disclosing personal information to third parties without prior consent from the Client.
Purpose and Legal Basis of Data Processing Data collected is used exclusively in connection with the services provided by GOLD GROUP SAS. It is necessary for managing commercial relationships, executing service contracts, and complying with legal obligations.
Client Rights Pursuant to GDPR, the Client has the following rights:

Data Security The Service Provider implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in accordance with Article 32 of GDPR. These include data encryption, strict access controls, and regular security audits.
Disputes In the event of a dispute, the Client is invited to contact the Service Provider to seek an amicable resolution. If no resolution is reached, legal avenues may be pursued.
Dispute Resolution Procedure In case of a persistent disagreement, the Client may refer the matter to the competent Consumer Mediation Authority free of charge, in accordance with Articles L. 611-1 and following of the French Consumer Code. Mediator contact details are available upon request from the Service Provider.
The Client may also access the European Commission’s Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr.
Jurisdiction Any dispute regarding the interpretation, performance, or validity of these GTCS shall be governed by French law and subject to the exclusive jurisdiction of the courts at the Service Provider’s registered office. As GOLD GROUP SAS is domiciled in Saint-Barthélemy, disputes shall be handled by the competent court in Guadeloupe.
Miscellaneous

Modification of the GTCS: The Service Provider reserves the right to amend these GTCS at any time. Updated terms will apply upon publication on the website and will govern all orders placed thereafter.

Severability: Should any provision of these GTCS be declared null or unenforceable by a competent court, it shall be deemed unwritten without affecting the validity of the remaining provisions.

No Waiver: Failure by either party to enforce any provision shall not be construed as a waiver of such provision in the future.

Governing Law: These GTCS are governed by French law. In the event of a translation into one or more languages, only the French version shall prevail in case of dispute.

Acceptance: The Client acknowledges having read and accepted these GTCS without reservation at the time of confirming their order.
